Brooklyn Bed Sore Lawyer
Brooklyn bed sore and pressure injury cases.
A serious pressure injury can raise questions about mobility, repositioning, skin assessment, nutrition, moisture management, infection, and whether changes in a resident’s condition were recognized and addressed. Deliso Law reviews the medical and facility record to determine what happened and what the evidence supports.

What we examine
The resident’s condition, the care plan, and the medical record.
Bed-sore cases are highly fact-specific. The presence of a pressure injury alone does not establish negligence. The review may include whether known risk factors were identified, what preventive measures were ordered, whether the resident could reposition independently, whether care was documented, how the wound changed over time, and what treatment followed.
Relevant materials can include nursing notes, skin assessments, wound measurements, photographs, care plans, nutrition records, transfer records, hospital records, incident materials, and testimony from people familiar with the resident’s care.
When Can a Nursing Home Be Held Responsible for a Bedsore?
The development of a pressure injury does not automatically establish nursing home negligence. However, federal and New York regulations impose important requirements concerning the prevention and treatment of pressure injuries.
Under 42 CFR § 483.25(b) and 10 NYCRR § 415.12(c), nursing homes must provide appropriate preventive care based on the resident’s clinical condition and must provide necessary treatment for existing pressure injuries.
An injury may be unavoidable despite appropriate care. Whether that is true in a particular case requires examination of the resident’s medical condition, identified risk factors, care plan, preventive measures, and medical documentation.
The fact that a resident was elderly, immobile, or seriously ill does not, standing alone, establish that a pressure injury was unavoidable.
What Evidence Helps Establish Nursing Home Negligence?
An investigation may begin by comparing the resident’s medical condition and skin assessments at the time of hospital discharge and nursing home admission.
Important evidence may include admission skin assessments, wound photographs, nursing notes, repositioning records, pressure-relieving equipment, nutrition assessments, physician orders, and care plans.
The timing and progression of a pressure injury may help determine whether a nursing home failed to recognize a developing wound, provide appropriate preventive care, or obtain necessary treatment.
Medical records must be considered as a whole. An incomplete or missing record may raise questions, but does not automatically establish that the underlying care was improper.
New York Law Protects Nursing Home Residents
In addition to claims involving negligence or medical malpractice, New York Public Health Law § 2801-d provides a statutory remedy for certain injuries caused by the deprivation of rights or benefits protected by applicable laws, regulations, or contracts.
A potential claim may involve the facility’s failure to provide necessary preventive care, treatment, or services required by nursing home regulations.
Whether a statutory violation or departure from accepted care caused a particular injury depends on the evidence and the applicable legal requirements.
Deliso Law reviews nursing home records, relevant medical evidence, and the circumstances of each case to determine whether there is a legal basis for pursuing a claim.

Depending on the facts, the same record may also raise issues involving falls, supervision, nutrition, infection, medication, transfers, or failures to follow a resident’s care plan. Deliso Law evaluates the full course of care rather than treating the wound in isolation.
